TERMS OF SALE

The owner of the online store Disainkaminad.ee (hereinafter referred to as the Online Store) is Disainkaminad OÜ (registry code 16476331), located at Vana-Tartu mnt 79a, Peetri, Rae vald, 75315 Harju County.

Sales Terms:

1. Validity of the Sales Agreement, Product, and Price Information:

1.1 These sales terms apply when purchasing goods from the Online Store.

1.2 The prices of products sold in the Online Store are indicated next to the products. The price includes a fee for the delivery of the goods. All prices of products sold in the online store are in euros.

1.3 The delivery fee for the goods does not depend on the buyer’s location or the delivery method within Estonia. The delivery fee is not displayed to the buyer when placing an order.

1.4 Information about the product is presented directly next to the product in the Online Store

2.Placing an Order:

2.1 To order a product, add the desired items to your shopping cart. To place an order, you must complete the required fields. The screen will then display the amount to be paid, which can be paid securely through the following payment methods:

  • Estonian bank payments: Swedbank, SEB, Luminor, LHV, Coop Pank, Citadele, Pocopay

PS! When making a payment with a bank link, be sure to click the “Back to the merchant” button on the bank’s page.

2.2 The agreement becomes effective once the amount to be paid is received in the Online Store’s bank account.

If the ordered goods cannot be delivered due to the product being out of stock or for any other reason, the buyer will be informed as soon as possible, and the paid amount will be refunded promptly, but no later than within 14 days from the date of notification.

3. Delivery:

3.1 Products are delivered to the following countries: European Union countries.

3.2 In Estonia, goods are delivered to the user by courier or with the option for the buyer to pick them up in person. In other European Union countries, goods are delivered to the user by courier only.

3.3 The cost of shipping is borne by the seller and is already included in the price of the product.

3.4 Generally, orders are delivered to the destination specified by the buyer within 14-21 business days from the effective date of the sales agreement. Outside of Estonia, delivery takes place within 21-30 calendar days.

3.5 In exceptional cases, the seller has the right to deliver the product within up to 45 calendar days.

4. Right of Withdrawal:

4.1 After receiving the order, the buyer has the right to withdraw from the contract made in the online store within 14 days.

4.2 The right of withdrawal does not apply if the buyer is a legal entity.

4.3 To exercise the 14-day right of withdrawal, the ordered product must not be used in any way other than what is necessary to ascertain the nature, characteristics, and functioning of the product as it would be permitted in a physical store for testing.

4.4 If the product has been used for purposes other than what is necessary to ascertain its nature, characteristics, and functioning, or if it shows signs of use or wear, the Online Store has the right to reduce the amount to be refunded based on the decrease in the product’s value.

4.5 To return the product, the buyer must submit a withdrawal declaration, the form of which can be found at this link and send it to the email address info@disainkaminad.ee within 14 days from the receipt of the product.

4.6 The cost of returning the product is borne by the buyer, except when the reason for the return is that the product does not correspond to the ordered product (e.g., incorrect or defective product).

4.7 The buyer must return the product within 14 days following the submission of the declaration or provide proof that they have handed over the product to the carrier within the said period.

4.8 Upon receiving the returned product, the Online Store will promptly, but no later than 14 days from the date of receiving the withdrawal declaration, refund all payments received from the buyer under the contract.

4.9 The Online Store may withhold the refund until it has received the returned item or until the buyer has provided evidence of returning the item, whichever occurs first.

4.10 If the buyer has expressly chosen a method of delivery that differs from the cheapest standard delivery offered by the Online Store, the Online Store is not required to refund the additional cost beyond the standard delivery.

4.11 The Online Store has the right to withdraw from the sales transaction and demand the return of the product if the price of the product in the online store was significantly lower than the market price due to an error.

5. Right to File a Complaint:

5.1 The Online Store is responsible for non-compliance with the terms of the contract or defects in the product sold to the buyer, which existed at the time of delivery and become apparent within two years from the delivery of the product to the buyer. Within the first year from the delivery of the product to the buyer, it is presumed that the defect existed at the time of delivery. It is the responsibility of the Online Store to refute this presumption.

5.2 In the event of a defect becoming apparent, the buyer has the right to contact the online store within two months at the latest, either by sending an email to info@disainkaminad.ee or by calling +37256880012.

5.3 The Online Store is not responsible for defects that occur after the product has been delivered to the buyer.

5.4 If the product purchased from the Online Store has defects for which the Online Store is responsible, the Online Store will repair or replace the product with defects. If it is not possible to repair or replace the product, the Online Store will refund all the fees associated with the sales agreement to the buyer.

5.5 The Online Store will respond to the consumer’s complaint in writing or in a format which can be reproduced in writing within 15 days.

6. Direct Marketing and Processing of Personal Data:

6.1 The Online Store uses the personal data provided by the buyer solely for processing the order and delivering the product to the buyer. The Online Store may provide personal data to transport companies to deliver the product.

6.2 The Online Store sends newsletters and offers to the buyer’s email address only if the buyer has expressed a wish to receive them by entering their email address on the website and indicating their desire to receive direct mail.

6.3 The buyer can opt out of receiving offers and newsletters at any time by notifying the Online Store by email or by following the instructions provided in the email containing the offers.

7. Resolution of Disputes:

7.1 If the buyer has complaints regarding the Online Store, these should be sent to the email address info@disainkaminad.ee or by calling +37256880012.

7.2 If the buyer and the Online Store are unable to resolve the dispute through an agreement, the buyer has the option to turn to the Consumer Disputes Committee. The Consumer Disputes Committee has the authority to resolve disputes arising from the contract between the buyer and the Online Store. The examination of the buyer’s complaint in the committee is free of charge.
